Gonna guess Schefter and most reporters don't sign HIPAA confidentiality agreements. If JPP didn't release that and someone else gave it to them, then the person that gave it out could be in trouble.

I'm going on the assumption that JPP didn't release it. If that's the case, and I haven't seen otherwise, the person who disclosed the information is definitely in trouble.

Based on the above, it seems that ESPN did not actually commit a HIPAA violation.
Did Schefter or ESPN violate HIPAA? The short answer is no -- "HIPAA laws apply to a very specific list of medical professionals," said Kelly McBride, a media ethics expert at the Poynter Institute. She was a former ombudsman for ESPN.
ESPN said the same thing in a statement later Wednesday night: "HIPAA does not apply to news organizations."
Was it smart for ESPN to take the information from its source and use it? My answer would be no, but I'd expect nothing less in the quest to generate click$.
