Aren't text messages backed up? I thought you could get them from the carrier. I had a program that saved all your text messages in the cloud, not sure why I had that program, but I did.

The NFL definitely does a great job of keeping itself in the headlines. This whole Brady thing is nothing more than a soap opera designed to be watched by men. I wouldn't doubt if Brady himself is fully aware of the fact that this is all about staying in the news more than it is about deflated footballs or whatever.

They're backed up if you want them to be backed up. But given that Brady had the phone destroyed, I doubt he would've left the backed-up data on the cloud.

Pretty sure they can get them from the carrier. See Kilpatrick, Kwame. However, that was at the request of law enforcement/Federal Government.

That's right. The NFL doesn't have that authority. But now that Brady is electing to take this to court, the court certainly has the authority.

I wonder if there is a difference in using a government issues phone and having that monitored, over a private citizen. I thought that is what got Kwame in trouble and it would make sense that a government employee would be monitored a bit closer than a private citizen.

The NFL is going to have to go to court and Goodell loses again. Brady's attorney is Jeffery Kessel who has taken the NFL to court on multiple occasions and prevailed.

Is replacing your damaged personal smart phone a violation of any Federal, state law or a violation of anything in the NFL player agreement? No.

It doesn't matter what anyone thinks, Brady cannot be tied to anything.

This is a civil matter and not a criminal matter so him being tied to anything with hard evidence is irrelevant. The court will look at the process and if the NFL followed the arbitration process per the collective bargaining agreement, the ruling will be upheld (Fuck you Brady and the Patriots).

My gripe is why does this even need to go to the federal courts. Just like the whole steroid issues with MLB it is a waste of tax payer dollars for something that does nothing for the public. It is being used as an event to try and shame people. WHO REALLY GIVES A FUCK, take the punishment and move on.

Technically, he could take a class one semester, which cost money. So you are correct, models and Super Bowl rings can't buy it, but money can.

I agree with those who think the NFL has a weak case in court (if there was no policy to begin with, how do they just make shit up as they go??), but Brady had already lost big here, in the court of public opinion. Even those who were somewhat pro-Brady are now turning their backs on him (e.g., Peter King).

So this is a lose-lose situation now.

All his case will do is open the door to other suits against the NFL on stuff that really matters. Isn't the NFL set up to be immune from legal jurisdiction on matters like this?

At this point I don't think Brady has cared about the court of public opinion for years. If that was the case he would have left the Patriots after other "scandals" years ago.

Robert Kraft is a better dressed, more politically savvy version of Al Davis who trusts his head coach and makes better payroll decisions.

I'm neither a Patriot or Brady fan. I don't like the way Goodell plays the game as commissioner. Whether it's reductions in punishments or not budging on rules. When the Lions were affected by the definition of a catch it wasn't important but when the Cowboys Dez Bryant makes a similar catch with similar results it's time to address the rule.

So I'm happy if Brady decides to hold the NFL's feet to the fire.
