Is it your contention that the legal system is fair and does not favor corporations, or are you being disagreeable just to be disagreeable?
It's my contention that Norfolk Southern is going to end up paying a shit ton of money out (whether they're evil or not), and it's sure as hell going to be more than $5.21/person (not to mention the cost the EPA is going to drop on them).
It's a little early to say what amount will be fair and if the legal system will favor them. My guess is they'll want to settle before going to trial. A judge or jury might award a hell of a lot more.

The part of the pitch is business knows their challenges better than any government entity and if they can self-regulate better than having interference caused by rules comng from the DOT, EPA, FDA and FEC.
How’s that working out?
The Tittabawassee River agrees.

It will be more than $5.21, yes. But just like equifax, I’m sure we can agree that it will be significantly less than the value of the actual damage caused.

They have provided reimbursement and cash advances for evacuees so far. If clean up takes awhile, I wouldn't be surprised if they offered reimbursement to move people from highly impacted areas.

According to a lady in my office Biden has said they won’t provide aid because it’s a Republican town.

Well for some odd reason the value of property in East Palestine has suddenly dropped. You wouldn't expect the rail company to pay more than market value.

Elected Republicans don't know whose who in their government.

Right, blaming the administration for this is like blaming the FDA for the leathery hotdogs at the Speedway.
I'm pretty positive Pete Budaggg didn't schedule the maintenance for this or any train....
Also, it will be fun to see some DOT employee listing all of the deregulation of the industry under Rs which eventually lead to where they are today. (Running unsafe trains too long with ancient safety technology)

The Republicans are walking into a buzz saw if they go after the executive branch.

Re: East Palestine OH Train
OMAHA, Neb. (AP) — The Federal Railroad Administration recently completed a review of Norfolk Southern’s safety culture in the wake of the February’s fiery derailment in Ohio, and officials plan to follow up with similar investigations of all the major freight railroads over the next year.
...
Federal regulators have said that safety data hasn’t changed enough to show that the railroads’ new operating model is unsafe. The figures do show that the rate of accidents per every million miles freight trains travel increased from 15.572 to 16.695 over the past decade even though the total number of incidents declined as railroads hauled less freight. The rate of accidents inside railyards also worsened from 11.044 in 2013 to 15.517 last year.
