FTC bans noncompete clauses
And employers must inform any employee working with a noncompete that the agreement is void. The ban goes into place in 120 days, and businesses are promising to head straight to court.

I’ve loathed noncompete clauses ever since it kept Catherine Leahan off Detroit tv news for months.

The swill’s army of lawyers have assured us that all of your non compete clauses remain in effect and you will still be banned if found to be posting on other message boards.

Good. This kinda goes hand and hand with with what the NCAA is dealing with in NIL and transfers. Powerful people with money trying to control their labor.
Interestingly enough we are in the process of signing a contract with a principal and it says we can't hire anyone from their company for 2 years after they leave. This was not going to stop me from signing, but there are some people over there that we would be interested in and it came up in our contract review.

How many NCs have ever been successfully enforced? I've never seen a good answer on that that I can recall.
I've been threatened with enforcement of them 2-3 times.

In my example above, it took going to court to free Catherine Leahan from her noncompete. But the judge only said she’d been sidelined long enough, not that the agreement was unenforceable overall.

This is going to get knocked down in court and will require an act of Congress to be implemented. Similar to the DOL fiduciary rules.

If you work in radio or TV non-competes are like being a sharecropper in the post Civil War South.
You rarely see movement from media conglomerates. If you move up to a larger market it’s to a station owned by the same ownership group. In TV you go from one Nexstar station to another, one Sinclair owned station to another and so on. In radio it’s iHeart and Cumulus.
The only time I’ve seen an anchor escape Sinclair was a few years back a 6 & 11 anchor left WWMT in Kalamazoo for the CBS news feed in Pittsburg. Sinclair played their non-compete card and CBS played its do you still want to be the CBS affiliate card, Sinclair blinked.

Against my will and better judgment, I was pressured into signing a noncompete at the radio station where I worked. I had already been employed there for a couple of years when the new policy was enacted. I balked hard, but the GM had become a friend and he played that up, along with the “you’re in a leadership position” card. What got me to sign was his quiet promise to make my contract disappear if he ever left the station or I wanted out. He just wanted to be able to say I signed when others tried declining. For all I know, he made the same promise to the rest of the staff because he was a good guy and easy to work for and most of us trusted him.

Oh look, we got us a real weisenheimer here. For your information, none of the lawyers I know would have a clue on how this will turn out. They’re all criminal defense attorneys and don’t know anything about employment or labor law.
