NEW YORK (AP) — A New York appeals court Thursday reinstated a gag order that barred Donald Trump from commenting about court personnel after the former president repeatedly disparaged a law clerk in his New York civil fraud trial.

The judge pulls out the biggest gun there is in US case law, not only slapping Trump down big time but setting up tSCOTUS for a challenge to its super Constitutional authority which was never the original intent of those who wrote the Constitution.

On Friday, U.S. District Judge Tanya S. Chutkan released her opinion in United States of America v. Donald J. Trump, batting down Trump’s claim that he possesses presidential and constitutional immunity in the Washington, D.C. case concerning his alleged role to subvert the results of the 2020 election and stay in power. “Whatever immunities a sitting President may enjoy,” she clearly stated, “the United States has only one Chief Executive at a time, and that position does not confer a lifelong ‘get-out-of-jail-free’ pass.”

The judge’s 48-page ruling is a powerful statement (and a necessary rebuke to this particular defendant) asserting that a U.S. president is not a king. Indeed, as she noted, in Federalist No. 69 Alexander Hamilton emphasized a “total dissimilitude between [the president] and the king of Great Britain”; in the latter case, there is “no punishment to which he can be subjected.” And more: “That widely acknowledged contrast between the President and a king is even more compelling for a former President,” underscoring that he is not exempt from criminal liability.

This liability, Chutkan wrote, “is essential to fulfilling our constitutional promise of equal justice under the law.” Quoting the Supreme Court’s decision in Marbury v. Madison from 1803, she noted, “The government of the United States has been emphatically termed a government of laws, and not of men.” And that principle refers to “citizens and officials alike.”

here is one of his defamatory statements: his contention that her allegation "is a disgrace and people should pay dearly for such false accusations."

What could he have said to make that non-defamatory?

Also to anyone who followed the original lawsuit judging him liable for the assault, does anyone know what kind of evidence was used to prove it? I'm having a hard time understanding how a rape that long ago (whether it happened or didn't) has enough evidence to prove he did it. I'm not discounting Caroll, i'm just surprised and am seeking to understand.

I think it's irrelevant. This is civil. There was enough to pursue it even if the DA didn't arrest him for it. He kept spewing and she sued him for it and he lost... and he's such a silver spoon fuck he won't stop. Because he doesn't know how.

She told people she knew at the time it happened about it. This is not an accusation years later, it is a history in which a number of people knew about it when it happened.

Not positive, but I think he has to put up the entire $83 million in order to appeal it. If he also gets nailed for the $350 million or whatever New York is going for he's going to end up filing bankruptcy. With any luck at all it happens before election day. Also the judge is right with his advise at the end of this case to the jury, don't let anyone ever know you were on it.

Couple of things I don’t know if she’ll see any money. The fact is if he’s going to appeal he hast to put $83 million down in escrow somewhere. Both sides agreed to. If he doesn’t please can start going through his stuff grabbing it and selling it.

He simply wants the justice system to work for him. He has for years and years abused the justice system. Now that someone has successfully used that same system against him for 80 million, now he mad.
