The bottom line is that too often, during the most critical times, it is law enforcement that effectively decides the scope of what expressive behavior is constitutionally permitted. This situation is an unsustainable burden on First Amendment rights—one that is especially concerning at a time of rising backlash against the right for speakers, crowds, even the press, to voice dissent. Americans could wait for the Supreme Court to clarify their constitutional rights. But they could also act now to demand that their legislatures vindicate the Founders’ protections for disruptive but nonviolent crowds, by limiting the use of tear gas, pepper spray, and other chemical agents in policing public protest, by circumscribing the discretion afforded to law enforcement to disperse crowds or to arrest individual protestors for catch-all public order offenses, and by demanding statutory limitations on crimes from obstruction of traffic to unlawful assembly and riot when applied to contexts involving expressive activity.
The right of peaceable assembly was included in the First Amendment to preserve the promise of fundamental change in the name of self-governance, to ensure the power to end a much-despised international conflict such as Vietnam or to demand fairness and justice for all who have encounters with the police. To serve this function, the authors of the First Amendment recognized that public assemblies must be permitted to be disruptive. It is time that we, in the 21st century, recognized the same.

I have a few 'friends' on FB that have started going all in on how you can be racists against white people, and white people who yell at others, are just as racist, or something like that. I roll my eyes and move on. For the most part I see people who are supporting the protests, but teh few that don't seem very angry. That is whta kind of has me worried about the election, even if Biden wins, the MAGA red hatters are going to get violent.

Considering how many (almost none) have come out to counter-protest like the president has asked, I think they've shown that their red hats belie the fact that they're yellow (insert Back To The Future III meme). And, of course, red and yellow make orange, so I guess it fits.

The Atlanta thing is a good example of an incident where most white people would be pretty comfortable saying it’s justified. A lot going on, frenetic situation, he already fought with the cop. But I heard an interview or something this week where the guy was talking about these incidents and observed that police need to take a beat at every stage of action against a citizen and say “what’s my goal here?” His example was George Floyd. Like at no point did the officer stop and say “this is about a fake 20 dollar bill. Is it really necessary for things to be going this far?” Likewise with the Atlanta thing, dude was found asleep in his car in the drive through at Wendy’s. The cops got him out and field tested him, he failed. At some point there was a struggle and he’s running away. They have his car. They know who he is. Why even bother chasing him? You can get him later. But cops have this mentality that they can never let anyone go and pick them up later. They have to elevate everything to 11. A fundamental change to police tactics has to happen. That’s what defund the police is all about and I’m all for it.

Roc I once saw a high speed chase through metro Detroit that stood a real chance of killing some people in cars or pedestrians or whatever. It didn’t, which was nice. What was the offense? Stealing $500 from a grocery store. A grocery store that has cameras. And probably cameras that got the persons plates. And insurance to recoup the $500. Why were we risking lives for that? But they don’t think like that.

I'm going to dissent on this one. I love Chappelle, and I'm 100% in support of the movement but I did not find this particularly compelling. DC was sloshed, slurring words, angry (as he has every right to be) and aimless. There are other statements/speeches, etc out there that I have heard that moved me a lot more than this one did. But my opinion doesn't really count. For me, it wasn't as powerful as some of the other things I've watched.

For how long it went I was fine with it. Definitely was pretty loose but I appreciated the raw emotion. I thought the Candace Owens parts were flat out mean and demeaning and I agree with him she sucks but I thought he went too far.

- The meeting was called by Burkina Faso, on behalf of 54 African member countries. Those nations are preparing a resolution that would call for an investigation into racism and police violence in the United States. The U.S. government would not be able to vote on the resolution, as Trump withdrew the country from the Human Rights Council in 2018.
