Initial gut check is that it might be tough to do before the election. The Susan Collins’ and the Cory Gardners’ are going to have quite the spot light on them.

At least if it is delayed long enough to not impact what decisions they'll have to make on the election.

Then again, even if they put Trump himself on the Court, I don't think that will matter. Robert's has shown to be pretty honest, and even Grousch and Kavanagh have gone against Trump. If they make a decision that benefits Trump, I'm confident that it will be based on what they really see as the professional, legal decision, not a political decision.

But let's hope it doesn't come down to the Court, eh?

There are no rules about the election, just standard ass the president nominates and the senate confirms.

As far as odds, it’s honestly way too soon to say and it’s all speculation for at least a day or two until senators go on the record (post death and not the stuff you’re seeing now that they said a month ago or whatever.)

Trump is going to appoint a third sc judge and the senate will confirm the judge.  Should have voted for HC.

The Supreme Court has not proven to be the roe v wade slaying monster that the right has hoped. The lower court appointments are proving much more helpful to The Trump agenda. The Supreme Court is being much more careful and considered in their opinions. Honestly, regardless of who replaced Scalia, America is better off. He was a zealot. Citizens United is the worst decision of my lifetime for sure. So far Gorsuch and Bretty K have not been that bad. I don’t remember what President it was. Maybe Truman? Anyway he was faced with an activist scotus and threatened to expand the court. There’s nothing in the constitution saying it has to be nine. That brought them in line. So whoever he appoints, I’m not super worried. I don’t like it, but anyway.

I’ll go back to my standard about the courts. If congress does its job, writes good laws and passes them, the court doesn’t matter.

So what are we looking at realistic worst case here? Like Roe v Wade might be overturned. Kind of absurd and our friend Goose will throw a party, but what else?

I doubt RvW gets overturned outright. Things like gerrymandering, taking away voting rights, states rights to limit access to abortion, preferential hiring for underrepresented groups, rich folks avoiding taxes, the burden of stricter environmental laws on corporations....

These are things I would see consistently being wins for the right in a 6-3 SCOTUS.

Again though, if laws are written in a scholarly manner, with an eye on court precedent, the court can’t do a lot. As it should be.

The outcome of the election, which may well be decided by the Court, will have a greater impact on all of that than this nominee will have beyond the election (including, quite possibly, another nominee or two).

There is a very real chance the election could be decided by the SC. In fact, I think it's more likely than not at this point. That's why Trump keeps harping on mail in ballots being "fraudulent." He wants somebody other than the electorate to decide this election, whether it be the SC, Russia, whoever.

Further, it's possible that all of the civil rights progress that has been achieved in this country could be reversed (Gay marriage, women's rights, Obamacare, affirmative action, fair wage laws etc.), although I'd say that would happen much slower. A very conservative SC will be deciding a lot of issues on one side for many years to come.

Maybe they do decide the election. If the numbers as they are now play out and the Democrats do their job, even if Trump is crying foul, which he will, they have no choice but to either not take up the case, or deciding against him.

A very conservative court is just one more reason to get the presidency and congress into democrat hands. And one more motivation for those wet noodles to stiffen up and get some progressive legislation passed.

If they don’t get these things done, we deserve what we get. And it won’t be pretty.

On another related note, does anyone feel like the last 4 years has been more like 8? Or 12? How is this only the end of one term?

My suspicion is that the GOP will pretend as if they care about the democracy in an attempt to hold on to the Senate majority in November and hold off on the process.

if they hold their majority, they'll continue with dismantling the democracy as usual.. if they lose their majority in November, they'll ram some misogynistic white supremacist through by years end.

They'll use this to drive their immoral, anti-traditional American values base to the polls.

By my nature, I'm an optimist.. this is probably the best case scenario.
