The actual facts about the McDonald's Coffee Case


The jury awarded Liebeck $200,000 in compensatory damages. This amount was reduced to $160,000 because the jury found Liebeck 20 percent at fault in the spill. The jury also awarded Liebeck $2.7 million in punitive damages, which equals about two days of McDonalds' coffee sales.

Post-verdict investigation found that the temperature of coffee at the local Albuquerque McDonalds had dropped to 158 degrees fahrenheit.

The trial court subsequently reduced the punitive award to $480,000 -- or three times compensatory damages -- even though the judge called McDonalds' conduct reckless, callous and willful.

No one will ever know the final ending to this case.

The parties eventually entered into a secret settlement which has never been revealed to the public, despite the fact that this was a public case, litigated in public and subjected to extensive media reporting. Such secret settlements, after public trials, should not be condoned.

You tools do realize a judge once ruled that "one nation under God" was illegal right? Then over turned in a higher court..... This is the part the lawyers always forget to mention.....because its very convenient to their industry....no lawyer will take this on since it gives like half of them jobs

East Lansing — Michigan State's softball coaches say they discussed whether to play a senior on the way to a game at Central Michigan in late April, not whether they would intentionally hit that player with a pitch during batting practice in retaliation for negative comments she made about the program.

Coach Jacquie Joseph and assistant Jessica Bograkos told Michigan State University Police, in a report provided to The News, they discussed if they would play Alyssa McBride while riding the team bus to Central Michigan for a scheduled game April 29.

Bograkos' account of the conversation to MSU Police contradicts what she told Michigan State Police earlier, when she denied there had been discussion with Joseph about McBride during the bus ride.

And they also spun "lets hit her" into her place in the batting order..... OK.


Bottom line bograkos is gone IF Joseph stays another year.

Each player gets hit an average of 10 times/year in batting practice?  And they are going to try and sell that?

Also, in all seriousness, if that shit is or isn't happening, there is a huge divide in that program it appears. Between players and coaches. I don't know why Hollis is dragging his feet. From an outsiders point of view, if I had a kid who could play softball, would I want them going to a program where coaches have to explain that type of behavior away? Time to cut the ties. It seems that snowball is rolling downhill too rapidly for it to stop. If this is all a bad coincidence for the coaches that's a shame, but there is a real divide and it needs to be dealt with.

If that was that conversation why did the manager hear Joseph tell Bograkos some like I can't do that but I can't stop you from doing that.
Why would a coach tell her assistant she couldn't tell the player she had to "sit" but that was the assistant's job. BULLSIT!

There's some serious CYA going on. The only people I feel sorry for are the other coaches who might want to continue careers elsewhere.

I coached 16U and 18U women and played fast pitch. Over 15 years of practice we never came close to hitting players 180 times a season in practice. It was more like less than 100 over 15 years including the 45-50 game seasons. If the players would have been getting dinged that often we wouldn't have been able to get players for a second year.

They had 64 batters hit in 55 games, and they want us to believe each player gets hit 10 times/year in BP?

I coached 16U and 18U women and played fast pitch. Over 15 years of practice we never came close to hitting players 180 times a season in practice. It was more like less than 100 over 15 years including the 45-50 game seasons. If the players would have been getting dinged that often we wouldn't have been able to get players for a second year.

They had 64 batters hit in 55 games, and they want us to believe each player gets hit 10 times/year in BP?

The sinking ship's crew is starting to disperse.

Hitting coach J.T. Grasso heard mama calling.  Literally.  He's going back to Norman OK to be OU softball's hitting coach.  His mama is Oklahoma softball coach Patty Grasso who just finished her 19th season in Norman.  Also leaving is J.T.'s fiance' Andrea Harrison who just finished her 1st season as a volunteer coach for Joseph.  Oklahoma's previous hitting coach left after 8 years to run a major baseball/softball facility in Woodlands TX.

I hope JT goes to confession regularly because that statement is big in the CYA department .  You'd think JT wants to get hired somewhere in the future and mama saw a chance to extricate her son from MSU's softball grease fire when she had an opening on her staff.
Now my tinfoil hat theory.  
The latest batting practice fiasco threw a wrench is any plans for a smooth change in easing Joseph off into the sunset.  The publicity combined with Joseph's wretched last 5 season has made the MSU softball job toxic, even with the new facilities.

Coaches cleared of any wrongdoings

“MSU's internal investigation found no indication of any wrongdoing by members of the MSU softball coaching staff,” university spokesman Jason Cody said in the release. “There is no indication that the student-athlete in question was intentionally targeted to be hit by pitches. There also is no evidence of retaliatory conduct on the part of any member of the MSU softball coaching staff. Investigators did not find any credible evidence supporting the allegations.”
